Customer Compliance Agreement

1. Authorized business use

Pacifica is provided only to verified businesses and properly licensed insurance professionals. The customer is responsible for every campaign, lead source, caller, representation, and insurance transaction conducted through its account.

2. Consent and Do Not Call compliance

The customer represents that it has a lawful basis to contact every person uploaded to the service, will obtain and preserve all required written consents, will scrub applicable federal and state Do Not Call lists, and will immediately honor every company-specific do-not-call request.

3. Calling practices

The customer must comply with the TCPA, Telemarketing Sales Rule, state mini-TCPA laws, calling-hour restrictions, caller-ID requirements, abandonment limits, and all other applicable rules. Pacifica may impose ring-time, pacing, attempt-frequency, suppression, and account-suspension controls.

4. Recording and AI features

Before recording, transcribing, monitoring, or analyzing a call, the customer must clearly disclose the practice and obtain the consent required in every applicable jurisdiction. A contract with Pacifica does not replace consent from the person called.

5. Insurance activity

Only appropriately licensed and appointed persons may solicit, negotiate, recommend, quote, bind, or sell insurance. Quotes displayed by Pacifica are estimates unless delivered directly through an authorized carrier integration.

6. Customer data

The customer may upload only data it is authorized to possess and use. The customer must not upload purchased, scraped, deceptive, or unlawfully obtained leads. Pacifica may investigate complaints, suspend campaigns, preserve compliance records, and terminate accounts presenting legal or carrier risk.

7. No circumvention

The customer may not use Pacifica to evade consent, disclosure, Do Not Call, call-abandonment, recording, carrier, or caller-identification requirements. Attempts to bypass compliance controls are grounds for immediate termination.
